Client Portal Accounts
Access to the ThinkOpen client portal requires an account provisioned by ThinkOpen. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these terms or pose a security risk.
Intellectual Property

Client deliverables such as audit reports, documentation, and remediation plans are licensed to the client per the terms of their service agreement. All client data, findings, and engagement details are treated as confidential information. We do not disclose client information to any third party without written authorization, except as required by applicable law. Mutual confidentiality obligations are defined in your specific service agreement. All ThinkOpen employees and contractors are bound by non-disclosure agreements.
Limitation of Liability
ThinkOpen Inc. provides services on a professional best-efforts basis. To the maximum extent permitted by applicable law: we are not liable for indirect, incidental, special, or consequential damages arising from the use of our website or services; our total aggregate liability is limited to the fees paid by you in the 12 months preceding the claim; this website and its content are provided "as is" without warranties of any kind, express or implied. These limitations do not apply to any liability that cannot be excluded or limited by applicable law.
Indemnification

Neither party shall be liable for any delay or failure to perform obligations under these terms due to events beyond reasonable control, including but not limited to natural disasters, cyberattacks, government actions, pandemics, or critical infrastructure failures.
Severability
If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.
Entire Agreement
